Frequently Asked Questions

Scrimsher Law offers a free Initial Review: A free 10-minute review of your legal questions and issues to determine if our firm will be able to assist you.

A Consultation is a paid meeting with attorney Noah Scrimsher that occurs after the Initial Review.

The Consultation expands on the Initial Review and digs deeper into your legal questions and issues to allow Noah to develop a strategy to best serve you.

Consultations are billed at a flat fee. Payment is due prior to the consultation. After clicking the “Schedule A Consultation” button and following the steps, an email will be sent to you with instructions on how to pay the consultation retainer.

A Flat Fee is the amount of money you will pay to Scrimsher Law for agreed upon services.

A Flat Fee is not a quote, it’s the exact amount of money you will pay for the agree upon services regardless of the amount of time Scrimsher Law spends providing the agreed upon services, subject to the terms of the Representation Agreement.

Flat Fees benefit clients by eliminating any shock or surprise at the amount of a bill due to hours under an hourly billing system. Scrimsher Law strives to bill for all matters on a Flat Fee basis, but occasionally, it is impractical due to the nature of the matter at hand.

A Representation Agreement is a contract between you (or your business) and Scrimsher Law, under which, you will pay Scrimsher Law a fee (generally a flat fee) in exchange for agreed upon services, subject to terms and conditions.

The Representation Agreement stipulates exactly what services Scrimsher Law agrees to provide.

The flat fee for a Consultation is due prior to the Consultation.

Flat fees for matters are due at the time of entering into the Representation Agreement. Scrimsher Law will not begin working on a matter until the fees are paid.

Retainers for matters billed by the hour, or matters billed using a mixed-fee structure are due at the time of entering into the Representation Agreement.

Fees (and retainers) are held in Scrimsher Law’s regulated IOLTA (Interest on Lawyer’s Trust Account) trust account until they are earned (i.e. Scrimsher Law provides the agreed upon services to the client). In the rare case that part or all of the fee (or retainer) is unearned, the unearned fee (or retainer) will be returned to the client.

Prior to your scheduled Consultation, either during the Initial Review or in a follow up email, attorney Noah Scrimsher will inform you exactly how to prepare for the Consultation to get the most out of it.

Generally, you will need to prepare any legal questions or issues, as well as all relevant facts, you want to discuss with Noah (for most matters, a questionnaire will be emailed to you in advance of your Consultation).

Payment of the flat fee for the Consultation is due prior to the Consultation.

Turnaround times vary from matter to matter, and may be dependent on factors outside of Scrimsher Law’s control (lack of communication from necessary third-parties, delays by necessary third-parties, etc.).

To assist in completing your matter as quickly as possible:

  1. Make your payment of your flat fee (or retainer) by the time the Representation Agreement is entered into,
  2. Respond promptly to attorney Noah Scrimsher, and
  3. Complete any “homework” given by Noah promptly and accurately.

Urgent deadlines should be brought to Noah’s attention as soon as you become aware of them.

Noah will work with you to meet when you are available. Scrimsher Law understands that work, childcare, and other appointments may make it difficult to meet during normal business hours.

Contact Scrimsher Law to inquire about meeting outside of normal business hours.

Visit the “Payments” tab to deposit or replenish a retainer, or to pay an invoice for services rendered. Retainers are held in Scrimsher Law’s trust account until the fee on the matter is (partially or wholly) earned.

Scrimsher Law utilizes LawPay, and online service, for payment of invoices and retainers. LawPay accepts credit and debit cards, electronic checks, and also offers Pay Later.

Pay Later is a financing service offered through LawPay, not Scrimsher Law, that allows clients to finance their legal fees in a manageable way. For more information, consult LawPay’s website.
